Effective 16 October 2026 · version 1.1

Terms of service

These terms are the agreement between you and the provider of Nequz when you sign up for or use Nequz. Please read them in full before you start.

Draft: awaiting a lawyer's review before launch.

1. These terms and who provides Nequz

Nequz is provided by an individual ("we" or "Nequz"), reachable at hello@nequz.app.

By creating an account, naming a business and accepting these terms, or by using any part of the service, you confirm that you have read, understood and agree to these terms and the privacy policy. If you use Nequz for a business, you confirm you may bind that business.

2. Definitions

  • "Service" means the nequz.app website, the dashboard, businesses' booking pages, the website booking button, the API and the emails the system sends.
  • "Business" means a workspace you create in Nequz and everything in it.
  • "User" means a person signed in as an owner or staff member of a business.
  • "Provider" means a shop or person who takes jobs from a business, such as a boat, driver, guide or dive shop.
  • "Partner" means someone who sends customers to a business, such as a hotel, guide or reviewer.
  • "Customer" means a person who books a business's service through Nequz.
  • "Your data" means data you, your team or your customers put into the service.

3. Eligibility and accounts

  • You must be of legal age and capacity under Thai law. The service is built for businesses, not for consumers or minors.
  • You sign in with a LINE or Google account and confirm your email on new devices. There are no passwords; keep your LINE, Google and email accounts secure.
  • Actions taken through your account are yours. If you suspect someone else has access, sign out of every device in Settings › Security and tell us at once.
  • Owners decide who is an owner or staff member and are responsible for the access they grant.
  • Business details you provide must be accurate and kept up to date.

4. What the service does

Nequz is software that takes bookings, connects owners with brokers, records deposits, calculates commission and produces monthly statements, based on the data and rules you set.

We may improve, add or retire features. If a change materially affects your core use, we will give reasonable notice.

5. Nequz's role in bookings and money

  • Nequz is not a party to the sale of services between owners, brokers and customers. Quality, cancellations, refunds and disputes are between those parties.
  • PromptPay or bank-transfer deposits go straight to the account the business set up. Nequz does not receive, hold or move customer money and is not a payment service provider.
  • Deposits customers pay by card or PromptPay through Stripe go straight to the business's own Stripe account. Stripe's terms apply between the business and Stripe. Nequz neither receives nor holds that money and takes no fee; refunds are made by the business in Stripe.
  • Commission and statement totals are calculated from the rules and data users record, such as the number of people who actually came. Both sides should check them before closing the month; once closed, that month's figures do not change.
  • Broker commission is paid directly between the owner and the broker, at the rate the owner set when the booking was made. Nequz neither pays nor guarantees it.
  • An owner may accept or decline a broker's connection request, and either side may end a connection at any time; bookings made before it ended keep their commission.

6. LINE and other third-party services

Parts of the service rely on others' services, such as LINE Login, Google Sign-In and Stripe, whose own terms also apply.

We are not responsible when a third-party service stops, changes its terms or limits use.

7. Plans and fees

  • Nequz is free for now. When we open paid plans we will give at least 30 days' notice, and features you already use free will not be charged retroactively. Brokers use Nequz free.
  • When paid plans open, plans and prices are as shown on the pricing page and in the dashboard when you subscribe or renew. Prices are in Thai baht.
  • Paid plans are billed monthly in advance and renew automatically until cancelled, by card through Stripe or by invoice paid with PromptPay.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are not refunded pro rata unless the law requires or we agree otherwise.
  • We will give at least 30 days' notice of a price increase, effective from the next billing period.
  • Fees exclude any taxes required by law.

8. Plan quotas

The free plan has no booking quota. We may limit abnormal or abusive use.

9. Your responsibilities and prohibited use

You agree to use the service lawfully and under these terms, and not to:

  • enter or send unlawful or deceptive content, content that infringes others' rights, or personal data you have no right to use;
  • send spam or unsolicited advertising, or deceive owners, brokers or customers;
  • access systems, data or accounts that are not yours, run unauthorised security tests, or evade usage limits;
  • use the API or automation in a way that places an unreasonable load on the service;
  • decompile, modify, reverse engineer or resell the service without our written permission;
  • use the service for unlawful activity, including gambling, money laundering or services that lack a required licence.

10. Your data and customers' personal data

Your data remains yours. You allow us to use it only as needed to provide the service, keep it secure and comply with the law.

For personal data of customers that a business enters or receives through the system, the business is the data controller and Nequz is the data processor under Thailand's Personal Data Protection Act B.E. 2562 (PDPA). This section is the data processing agreement between us:

  • We process that data only on the business's instructions, given through its settings and use of the system, and never for our own purposes such as marketing.
  • We maintain appropriate security measures and bind staff with access to confidentiality.
  • We use only the sub-processors listed in the privacy policy and hold them to protection no lower than this.
  • We notify the business without undue delay of a personal data breach affecting its data, and help it answer data subject requests as far as the system allows.
  • When you stop using the service, we delete or anonymise the data as set out in section 17.

The business is responsible for having a lawful basis to collect and use customer data, for giving customers its own privacy notice, and for answering their requests.

11. API and integrations

Owners can create API keys, API clients and webhooks. Keep secrets safe, never put them in browser code, and revoke them at once if exposed. API calls made with your credentials are yours. We may rate-limit calls to keep the service stable.

12. Intellectual property

The software, design, marks and content of Nequz belong to us or our licensors. These terms give you a non-exclusive, non-transferable right to use the service while you subscribe. If you send feedback, we may use it to improve the service without obligation to you.

13. Availability

We aim to keep the service available, but it may pause for maintenance or fail for reasons outside our control, such as infrastructure providers, the internet, or LINE and Google services. We do not promise the service will be uninterrupted or error-free.

14. Disclaimer

To the extent the law allows, the service is provided "as is" and "as available". We do not warrant that it fits your particular purpose, or that calculated figures are right when the data or rules entered are wrong.

15. Limitation of liability

To the extent the law allows, we are not liable for indirect or special damages, or for loss of profit, revenue, customers or data, arising from use of or inability to use the service.

Our total liability to you is limited to the fees your business paid us in the 12 months before the event.

These limits do not apply to damage caused by our wilful misconduct or gross negligence, or where the law does not allow liability to be limited.

16. Indemnity

You agree to compensate us for reasonable losses and costs if a third party claims against us because of data you entered, your use of the service in breach of these terms, or your breach of the law or others' rights.

17. Suspension, termination and data afterwards

  • You may stop using the service at any time by cancelling your plan and asking us to close the business.
  • We may suspend or end access immediately for a serious breach of these terms, a threat to the system or others, or where the law requires; otherwise we will give reasonable notice.
  • Before closing, you can download statements as CSV and fetch bookings through the API.
  • After a business is closed, we delete or anonymise its data within 90 days, except data the law requires us to keep, such as accounting and tax records of fees.
  • Sections that by their nature survive, including sections 12, 14, 15, 16 and 19, continue to apply.

18. Changes to these terms

We may update these terms from time to time. For material changes we will notify you in the dashboard or by email at least 30 days before they take effect. Continuing to use the service after that date means you accept the new terms; if you do not, you may stop using the service before then.

19. Governing law and disputes

These terms are governed by Thai law. The parties will first try to resolve disputes in good faith; failing that, the competent Thai courts have jurisdiction. If any provision is unenforceable, the rest remains in effect. The Thai version prevails.
